What is Form I-824 and who can file it?

O Form I-824, Request for Action on an Approved Application or Petition, is primarily used to request approved documents from USCIS, but can also be used to request action on an approved petition or application.

You can file Form I-824 if:

  • You are the person who initially submitted the application or petition to USCIS
  • You are an authorized representative (such as an attorney) of the person who initially submitted the application or petition to USCIS
  • You are the beneficiary of an approved petition (a Green Card applicant)

Form I-824 Use Case Examples

Most individuals will not need to file Form I-824. However, we have provided some examples below of individuals who may need to.

Case 1: F2A visa applicant

Ricardo married a legal permanent resident and is seeking a visa F2A . His wife entered the US over a decade ago and seems to have lost her Form I-130. Ricardo’s wife has looked everywhere but can’t find it. He even checked his USCIS account online and the I-130 record is no longer there.

Ricardo’s wife would need to file I-824 to receive an official petition to replace Form I-130. This will ensure that there are no delays in Ricardo’s F2A visa application process. It will likely be needed for Ricardo’s green card interview.

Case 2: Unable to find the alien registration number

Adriana has looked everywhere. But she just can't find the Foreigner Registration Number (Number A) that was assigned to her when she entered the US. She needs to find the A Number to file a Form I-130 petition on behalf of her daughter who is seeking an F2A visa. She can't even find her Green Card at the moment.

Adriana could file an I-824 to receive a replacement Form I-130 in just a few weeks or months. Adriana will likely also need to file a Form I-90 to replace her green card if she can’t find it. But that could take well over a year to process. So filing an I-824 for a replacement I-130 would be your best bet in this case.
