What is Usucapion?

Adverse possession is an institute of civil law that allows the acquisition of ownership of a movable or immovable asset by someone who owns it continuously, peacefully and uninterruptedly for a certain period of time, established by law.

In Brazil, adverse possession is provided for in the Civil Code (Law No. 10.406/2002) and can be applied to different situations, such as urban, rural, family adverse possession, among other modalities, each with its specific requirements.

In general, the common requirements for the configuration of adverse possession are quiet and peaceful possession, without opposition from the true owner, for a continuous period determined by law (which varies depending on the type of adverse possession), in addition to fulfilling other specific requirements established for each type of adverse possession.
